EU Member States Trusted Lists Scheme Type Community Rules: specific statement for Hungary

Services included in the Hungarian Trusted List of Supervised/Accredited Certification-Service-Providers are assessed for compliance with the provisions of the Act XXXV of 2001 on electronic signatures (http://www.nhh.hu/index.php?id=dokumentumtar&mid=632&lang=en), the legal regulations implemented under authorization by this Act, in particular the Ministerial decree No.3/2005 (III. 18.) IHM on the detailed requirements for services related to electronic signature services and their providers and Government decree No.45/2005. (III. 11.) on the responsibilities and powers of the National Communications Authority connected with electronic signature services and the detailed rules of procedure (unofficial translation of both decrees available at: http://www.nhh.hu/index.php?id=dokumentumtar&mid=633&lang=en). The assessment is also carried out against the relevant generally recognised standards voluntarily applied by CSPs and the terms and conditions governing the services of the CSP.

The CSP Supervisory Body and the National CSP Assessment Scheme maintaining the Trusted List are the very same organization in Hungary. See: Magyarország (Hungary): Trusted List, 1. Scheme Information. A voluntary accreditation system for CSPs is not operational in Hungary at present.

The Hungarian CSP Supervisory Body (the Scheme Operator) performs supervision of services to the public of the following type of CSPs and includes them all in the TSL implementation of its Trusted List:

  • CSPs issuing Qualified Certificates (QCs)
    Qualified certificates in Hungry are always supported by a secure signature-creation device (SSCD) and issued to natural persons only.
  • CSPs not issuing QCs but providing ancillary services related to electronic signatures:
    • CSPs issuing Non-Qualified or Public Key Certificates
    • CSPs providing Qualified Time-Stamping Services
      Qualified time-stamping services are subject to higher requirements in terms of security, service continuity and reliability as described in Act XXXV of 2001 on electronic signatures and its implementing regulations.
    • CSPs providing non-qualified Time-Stamping Services
    • CSPs providing qualified Long-Term Electronic Archival Services
      Electronic Archival Services offered as qualified services are subject to higher requirements in terms of service continuity and reliability as described in Act XXXV of 2001 on electronic signatures and its implementing regulations.
    • CSPs providing Long-Term Electronic Archival Services
      Electronic Archival Services at this quality level are not offered in Hungary at present.

Common to all services supervised is a requirement for the CSP to notify to the Supervisory Body at least 30 days prior to the intended commencement of its relevant service. Along with the notification the CSP is required to provide as a minimum: administrative and identification information and a Certification Practices Statement.
